I doubt the lady who suffered a broken wrist and had surgery, but faces another surgery because it isn't healing, would agree with you.

 

Been there, done that.

 

I still have a titanium plate in my arm from an airbag accident in 1995, just wouldn't heal, after several surgeries and a bone graft.

 

Not fun.

Ditto .... IMO, she's entitled to a settlement for her injuries, medical bills and time lost from work!
