I think you misread. The "mistake" isn't being attributed to the couple, it was a bank mistake.

Last year DH and I went to drive thru at our bank, cashed a check for $40.00 and got coin wrappers. I went around to the parking lot and DH asked what I was doing. I told him that I was checking the envelope. He chuckled at me. Lo and behold I had $400.00. I said to DH "and this is why I check."
We went back to the drive thru, you never saw such relieved faces. They said we just called your house. If it's not mine, I don't want it.

That was kinda dumb for them to spend that money!
One day I was $80,000 richer...the money just appeared in my bank account. I didn't call the bank right away and was certain that it was going to be taken care of soon...but it did not! It was there for weeks and I was concerned that I would have to pay tax on it. In my mind I was thinking: "How am I going to prove the money isn't mine and that is just appeared out of nowhere?" So I let it go because I was afraid. It never crossed my mind to spend it, not even one single penny of it. So after weeks had passed it finally disappeared with no explanation from anyone, not my bank or anyone else. Strange!

@CrazyKittyLvr2 Bottom line, they are thieves. No ifs, ands or buts. They knew exactly what they were doing and that it was wrong. Shame on them.

They spent the money in 2 weeks time, on an SUV, a camper, a car trailer, 2 top of the line ATV's, paid bills and gave $1,500 to a "friend in need".
In spending that money, they also amassed $107,000 in overdraft fees once the error was reversed and the bank is expecting them to pay that also, and rightfully so, IMO.
Maybe that'll teach them to be honest in the future....but I doubt it.
People are either honest, or they're not.

Do we know how much time elapsed before they "spent it all?" I can't imagine what I would buy worth $120,000! Anyway, this was definitely a sin of omission.

They were both charged with several felonies, released on $25,000 bail, which was probably left over from tha bank's money!
