@tansy   yes. I am surprised as you.. You have a very lax HOA, @SeaMaiden, and $200. annually is a very small amount for a HOA fee.

Once you have an HOA that doesn't uphold standards, it's all downhill from there.

They need to begin by taking away perks, like pool and courts. Something to get them moving.

And you're right, you will have a hard sell with both neighbors like that, and they will bring down the value of your home.

The HOA needs a kick start! Give warnings, give small time for fixing, punish or place leins on property.

That's a nasty problem, @SeaMaiden.

I guess it's just difficult to understand how or why, anyone allows their property to fall into such deplorable conditions-

 

I thought as well, the HOA might not have the funds to legally pursue the homeowners-

You only pay $200 PER YEAR? That's peanuts for HOA fees. You should reread your covenant to see what exactly your HOA is responsible for. 

 

In my community, if a household is notified three times and the problem is not corrected, a fine is imposed. Those fines increase as well as losing privileges - gym, pool, and your passes for gates to enter is shut down.

 

You might want to start calling your HOA on a regular basis until that place is cleaned up.

 

BTW, I don't think your other neighbor had an epiphany, I think they probably got a lot of fines levied on their house. Its usually money that gets people moving.

@riley1. No gym. No gates, no pool....just a park.  Perhaps if it were a more upscale  community things would never be allowed to fester.

My parents lived in a 55+ community that was governed by a HOA - the fee was $12.00, yes $12 a month and for that, they got nothing at all, no amenities, no snow removal, landscaping, nothing except for the appointed busy body Deputy Dawgs sticking their noses where it didn't belong.

The pictures posted, IMO are not that bad at all. You should see where I live!  I am glad that I am not under an HOA. I don't want to ask permission to paint my house. Here, many people don't use their garages to put cars in.

@SeaMaiden....I do not live an area with an HOA....so I am not sure about all the rules but if it were me...I THINK....I would quit paying the fees...what are they doing for you or the neighborhood.?  I would be furious that they do not enforce the rules.

As for the HOA - here is how this works - the homeowners are given a lot of notice about where they are breaking the rules - then the HOA can start legal action - this takes years to complete. Finally  if they still won't comply - the HOA can force them to sell the house to the HOA - the court will set the price - then it becomes the HOA responsibility to clean & rehab it so they can sell it. All in all - it costs the HOA a ton of money - so usually , they don't do anything. Just the legal fees would wipe out most associations.

I agree with Deserti - at a HOA fee of only $200/year that HOA is unlikely to have any funds.

My husband and I have a small townhouse outside the city for work.  Beautiful grounds, no amenities.

 

Our HOA fee is 200.00 per month-for that fee they maintain everything outside of our homes;  all property, mowing, gardens, sidewalks, parking, buildings, painting, repairs, gutter cleaning, enforcement of rules (vehicles aren't even allowed to have advertisements etc.) chimney cleanings, inspections, etc.

 

So, I guess I'm just at a bit of a loss as to why a HOA would wait so long to enforce the rules-That property didn't become uninhabitable over night and the homeowners were in violation of their agreement.

 

I personally don't think economic class has anything to do with it-It's an individual matter of disrespect for their property, their investment, themselves and for other people.
