Kohlberger might walk on Idaho murder charges

News reports today say Brian Kohberger's defense team

" trying to get critical evidence thrown out as they raise questions about how law enforcement zeroed in on the Pennsylvania Pocono native. "

 

" Bryan Kohberger will be back in court this week for hearings that will likely set the table for his trial later this summer.

Since November, the defense and prosecution have argued over evidence in the case.

The pieces the defense wants suppressed include DNA the state says matches the crime scene. Every item seized from Kohberger's apartment, car and parent’s home. And all the information from his cell-phone and online footprint.

They say the evidence should be withheld due to police misconduct.

The defense is also seeking to block use of Kohberger’s genetic information in the case, saying that his fourth amendment rights were infringed upon through techniques the FBI used. "

I just finished reading that article on the Fox site.  Absolutely incredible that could be a possibility.  Makes my blood boil to think he could get away with the killings.

I'm assuming because the evidence against Kohlberger is so damaging that his lawyers are trying anything to help his case. At least, I'm hoping that is the situation.

 

I never understood, and never will, how an attorney can do a job defending someone that is definitely guilty. They look for every loop hole to help their client, knowing all along they are guilty. I realize everyone has a right to an attorney and prove innocent but it is just disturbing. It is a game to the defense attorneys.

Every defendant has the right to challenge all evidence and evidence collection procedures.   It's a  standard part of a vigorous defense process.  Doesn't mean the judge will agree.

You reminded me of those commercials for mattresses.  People do bad things and are asked how do you sleep at night.  Their response is I sleep on so and so mattress.  The commercials are funny.

We'll see how good his lawyers are, it's chilling to think he could be set free.

Let me start by stating I have read every article and seen many news reports on this man. Do I think he is guilty yes I do. 

With that being said everyone is innocent until proven guilty. This is in the Bill of Rights. It is up to his lawyers to defend him.

I know if I was accused of a crime I would hope I would be able to have the best defense attorney and that the rule of law is followed. 

 

In the best interest of justice for the innocent victims the law has to be played out.  

 

There are over 20,000 innocent people in prison today. Some for decades. 

 

Let the lawyers and judge do their job so that justice can be served. 

 

And again I do think he is guilty. Just pointing out the rule of law.

Good grief!  Let's just hope it's nothing more than a nice try on the defense teams part. It's unimaginable that ALL 'critical evidence' would be thrown out.

 

It's the defense team playing card, since they don't have much else, if that critical evidence stands. I can only imagine the uproar if Kohlerger walks. But, it's a just a game and the best team wins. 

 

What a disappointment, if the evidence collectors actually did mishandle evidence and had misconduct. It will shake observers confidence in the legal system forevermore. After all, it's already been in question for many. It's a bit of a snake pit. JMHO.
