I know this is a DP case because it is in Florida. If this had happened in Maine or West Virginia it would not be an issue.
I have a problem with th eway our system deals with the death penalty. We are all tried under the US Constitution but sentanced under State constitutions. This IMO is wrong.
First: There is a challenge to the constitutionality of applying the DP to a case in Miami and the defense is trying to have it applied here.
Second: As cold and evil as this makes me sound I have a problem with the DP being applied to Casey and not Andrea Yates or Susan Smith. They killed more children than Casey and when a woman systematically drowns 6 kids in her bathtub that is far worse than what Casey did.
It is the inconsistancy with which we apply the death penalty in our country that bothers me.
I hope Casey gets Life without Parole, it will stand a much better chance of being upheld on appeal - as much as it sickens me that the people of Florida will have to provide food shelter and medical care for this person for probably the next 60 years!
