That would be the worst for my husband, since he never had a lawyer.

I think your husband needs a lawyer.

Any fees should come out of the estate. No beneficiary should pay anything out of pocket.

We are in another state, and lawyers cost $300 plus per hour.

He may get slammed with legal costs for these two as deduction from the amount of money he would inherit. It is not out of pocket, but it comes from your money anyway. And you get no real say in it.

We decided not to spend more money on this. They are spending enough as it is.

hyacinth...brother #1...is he well off or financially strapped?

Probably well off. People who need money don't pull this kind of thing. The estate must be several hundred thousand per person, minimum, for people to be acting like this.

Re: I'd rather have enemies than ""family""

blue crocus...that was a friend's experience. The one with the most took it all.

It was an uncle, not a parent...so no siblings. And the uncle had no children but there were other nephews/nieces (the guy had siblings). The guy managed to get everything signed over to him before the death with lies and promises. And nobody suspected a thing until it was done.

The saddest thing was the uncle had a sister who looked after him after his wife died for years until it became too much. These people were in their 80's. He went to a nursing home where she saw him twice a day to pick up laundry and see that he ate.

The guy sent her a small check, said that was what her brother wanted her to have.
