My husband's oldest brother has again messed up his father's estate. It has been almost a year, and the house is unsold, rental money hasn't been given to his brothers, money from his dad's bank accounts hasn't been given, and he hasn't paid back the $20,000 he owes the estate.

Last month, all 4 brothers signed a "binding agreement" to have the house independently appraised. The agreement stated that all would be bound by the appraisal in determining the price of the house. The 14 page appraisal came to us last Friday.

Oldest and 3rd brother have always wanted to purchase house from my husband and youngest brother. Now, oldest brother has said he is "challenging" the appraisal as he thinks it is too high. He's claiming some conspiracy and who knows what. The binding appraisal was prepared to avoid just this.

I thought after almost a year we could get out of this and never hear of it or these two brothers ever again. The only thing I can see left for him to do is not get a loan to buy the house, even though he has said over and over he is working on it. The appraisal was the last piece of info needed to approve a loan or not. I think he is stuck with the appraisal, but I doubt you can force someone to honor his word in getting the loan. I just don't know how someone can do this to their brothers, and don't know what the next move is.
