I've sold for many years on eBay and have some questions ....

This was a "used" item, correct?

Was it listed as a final sale?  In the ad, what is the seller's return policy?

Have you contacted the seller about this?  If so, what did they say?

Yes, there is a buyer protection plan, but I don't get from your comments that the item was misrepresented.  You bought used clothing.

Contact the seller first, and see if they will at least partially refund your purchase price.

as a seller I don't offer partial refunds...you have to return for a refund

@jackthebear

I understand, but if the item could not be resold when you get it back, why pay for the shipping label for the buyer to send it back to you, if you're only going to throw it out?   You'd be out another $5 or so for no reason.

JMO .....  Sometimes the return process isn't worth the trouble.   Just issue a refund and move on.

yes that is true, so as a seller, you have to feel it out
is the buyer trying to get a discount, or a genuine return?

how long have i had the item and my cost of goods etc

I was trying to explain it all the the OP,

@jackthebear Thank you but I do not need one I am not looking for anything from the seller. I am just going to take the loss if the smell does not come out

@I am still oxox

I forgot to mention ... whether it works out or not, I think you should let the seller know there was a problem.

They may have an employee who didn't handle this correctly.

As a seller, I certainly would want to know.

Why?   Next time .... please TELL them.    Allow them the option to make it right before you leave negative feedback.

For some people, this is an income source, not just a hobby.  Leaving bad reviews without notifying the seller of the problem doesn't help anyone.

JMO, of course.

@I am still oxox  -  You should have communicated with the seller and given him a chance to make it right.  Now the seller has a bad review without an opportunity to correct it.

Not a good idea at all to leave a review - thinking you mean feedback? - before talking to the seller.

Sellers have options and sometimes if the buyer isn't happy the seller will issue a refund and you keep the item.

Most sellers will make things right and you didn't give them the opportunity.
