States do vary in how these settlements can be dispersed. Medicare and Medicaid are two different things, even though the state always has its hand out for everything it paid for the care of anyone who received money from them upon their death.  I would have a reputable attorney review your case.

Online there are very high and very low ratings for attorneys...no way of really knowing if they are based on legitimate experiences...it's still a gamble if you hire someone without doing your own due diligence. I think personal referrals based on word of mouth works best for me.
