I'm assuming SHE will sue and I won't have to.

I'm not sure about the restaurant, but some business may well have had something going. Fingers crossed. My niece has recommended a body shop they were highly satisfied with.
Might be best to take it to the dealer or dealer's collision center where you can insist on the right parts for your car from the manufacturer or secondary market. For instance, if you go to the dealer's body shop and you have a Toyota, you'll get Toyota parts put in. If you have an extended warranty on your car that you purchased, you'll need to be sure you don't render that void by getting non-manufacturer's parts and you can't be sure of that elsewhere.
@Pearlee, will have to check with Hyundai dealership. My niece (with whom I live) has a Sonata and she has a local body shop she was very pleased with for her car when someone hit her. Will go with that one unless the local dealer does their own body work (which I don't think they do).

There have been a lot of car out of control accidents where brakes couldn't stop the car.
Some years ago in SO CAL a guy on the freeway called for help from his speeding car where the brakes, hand brake and shifting gears did nothing.
I hope the injured guy makes it.

I think Toyota had to pay a billion+ fine a few years ago because gas pedals on their Lexus automobiles were sticking. Several people were killed.

@Moonchilde~~~I am sorry this happened to you, but glad you were not in your car. Yes, I do that futile exercise of the "what if" game when bad things happen through no fault of your own. It doesn't help a thing, but I think it's human nature to go back and try to analyze things we could have done differently to have prevented it.
Prayers go out to the severely injured good samaritan for his full recovery.
Good luck with all of the insurance red tape and hoops you may have to deal with....on the other hand, it may go very smoothly.....I hope for you the latter.

Yes, I have had that "what if" or more often..."that could have been me if it had happened 5 minutes earlier" type thoughts. I am glad you weren't in your car. I think things happen for reasons we don't understand but there is always some kind of lesson in it for us.

How horrible for all of you. Today, someone I know is taking their car in for service, and I keep worrying that it might breakdown on the bridge or on the busy highway and she could so easily be hit by a speeding truck. My DH says it will be fine, but I have a tendency to think "what if".

A couple years ago a elderly man here came out of Applebee's, got in his car, went to back out of parking place and shot straight ahead mowing over a landscape employee who was trimming a hedge. The poor victim died.
I can't be sure, because people dye their hair, but by what I saw I'd say in her 50s. She had called out for help before the accident saying she coudn't control/stop her car. What I don't understand is why not hit the BRAKE?
Or put the car in neutral and shut if off! Did she exit her vehicle while it was out of control? I was curious how the door hit her?
