About a Disability Hearing...???

There was a post (thread) started here about a week ago where someone wanted to know what happens at a Disability Hearing after they had been "denied" twice. There were about 3 replies and nobody seemed to know. Then, it disappeared.

All I can tell about, is what happened with one of my sons. The only people there were him, his Disability Attorney, the Judge and an employment advisor who tries to offer jobs, depending on his Disability. There was also an "independant" doctor on the phone, who talks with the Judge and everyone is listening.

The Judge goes over the medical reports and the doctor gives his opinions. Then the "advisor" makes a job offer which, he admits at the moment, none are available.

After the Hearing, which took about 1/2 hour, everybody left. My son and his Attorney left, feeling confident that they had won. There are some people who think just because they come into the Hearing with multiple files and medical reports, that they have a good chance of winning but it's just the opposite. That could mean that they have a lot of little problems but not enough to consider them "disabled." According to the Attorney, they are probably able to do some sort of work, depending on their skills, education and/or qualifications.

I don't know why most people are turned down twice and most times, turned down again after a Hearing but again, I think it depends on their disability and what the "telephone" doctor says about it. Then, the Judge makes the final decision.

My son got his letter about 10 days later and it was "fully favorable" - something he and his Attorney felt sure about. I think they go back about 2-3 years and send a lump sum check and then monthly payments.

I hope this helps the poster who started the thread. I can't think of anything else.
