Thats really stupid of the company. I bet their attorney would have a fit. If somebody gets an eye infection because they used the wrong color on their eye, it leave them wide open to lawsuits.

Until I recently did a deep declutter of my eyeshadow palettes, I had about 50 of them. It is not uncommon for eyeshadow palettes to have disclaimers that some colors may not be safe for the eye area. I'm sorry, what? If the FDA says they're not safe for the eye area and it's freaking eye make up, then how can they sell it? I don't know the answer to that question but a lot of the deeper shades that can cause staining and the chunky glitter Shadows both can carry These Warnings. This information isn't stamped on the front of an eyeshadow palette where it seems like it would be, but you'll be able to find it on the back with all the ingredient listings. I've knowingly worn Shadows that had "not safe for eye area" warnings. The biggest offender of eye staining are shadows in the red range.

@San Antonio Gal @I've seen this before with a brand that 20 somethings and teens buy. I saw the brand on YouTube and then went to its website. They sell online. They had many palettes with shadows that could not be used near the eyes. It's ColourPop Cosmetics. They had radically wild colors and textures for those that like to experiment with artistic looks. The girls reviewing paid no heed to the label and used the shadows anyway. I wish the FDA had the authority to prohibit the sale of these, especially when they are included in an eyeshadow palette. Some of the ones could be used on the body or other areas of the face such as cheeks or forehead but they could still have fall out that gets into the eyes, They're labeled as face pigments on your photo. At ColourPop they say the shades can not be used in the immediate eye area. They suggest use on the temples or under the brow bone.

The product is not labeled eye shadow but color palette. The front label of the product indicates there are 5 face pigments and 11 eye pigments There are many brand that include eye and face products in the same palette. I have a Mally and IT palette with eye and face products. IT beauty book has lip product included too

If they put the warning on the product that it's not safe to use in the eye area and someone does it anyway doesn't that make the company not responsible?

@monicakm It depends where the warning is posted. If it's on a separate brochure, it could be overlooked or a person who never had access to it might use the pallette. It seems very unwise to have the "bad for eyes" interspersed with the rest of the colors. They would be undistinguishable.

In a lot of eye palettes, they contained pressed pigments. As someone mentioned this is usually due to staining on the eye lids. For this reason, the FDA requires that warning. In the EU, their version of the FDA approves of eye pigments as being eye safe; no warning on the same product. NYX is sold worldwide; US is the only country who requires the warning due to staining.
From Temptalia's site: NOTICE: All products categorized under "Pigment" carry a warning in the US that the product is "not intended for use in the immediate eye area." Brands in the US typically market these products as "Pigments" (instead of "Eyeshadow"), and there is often a warning on the back of packaging or the label. The product includes color additives that are not approved for usage on the eyes per the FDA. Some color additives in "Pigments" have no usage restrictions in the EU, per CosIng, and can be used on the eyes. We recommend checking ingredients to confirm current safety assessment/restrictions: FDA/CosIng.
