Amazon selling "semi-new" cosmetics and bath things!

I just got some LG blush form Amazon that was identified as New. It arrives and there's no plastic covering or box that contains it. Write seller asking what's the deal and they say it was part of a kit, so "new without box". But how do they know it's new? Who handled it before the seller???

Then I get some Vitabath bubble bath. (Thanks for the rec!) It was also described as "new." I write the seller to make sure, and they say "It's not new from the manufacturer but it's stored in good condition." What the hay???!

Tell me ladies... is this legal? I thought cosmetics that were not in new condition -- including protective packaging -- could not be sold.

I'm on the fence about keeping the blush but definitely don't want bubble bath that's not NEW!!!

I'm also contacting Amazon CS.

Would you keep the blush?
