Op needs to take little stuff out now. Take photos of things, for documentation for the courts later on. (Not your phone if your dh looks at it)  Once the papers are filed you are not supposed to take items out of the shared home, that is joint property (Yes, people take items out anyways)

Again, the Op needs to act like nothing is changing.  You do not want your dh to pick up on any cues. In your situation, it could be like the movie: The War of the Roses.

  This kind of person is a menace and should be dealt with as such. The police cannot protect you from this type of person, as you obviously already know.

  I would consider going to the police station, accompanied by my DD and SIL as witnesses, and telling them that he threatened to kill you.

  You said he has threatened you in the past.

  He needs to be behind bars long enough for you to get yourself resettled although I'm afraid he will be a continuing danger to your safety.
