The 79 yr old lady who sued McD was in a car but I don't think she was driving and her flesh was burned off due to the overheated coffee so that was not frivolous.
All she had asked for was to cover medical bills and McD dug in and the suit was necessary. Google the pictures of her injuries requiring skin grafts if you have a strong stomach. Lot of misinformation out there and urban legends about that particular case.
I agree. She was the passenger. I always stick up for her when someone brings the subject up. McDonald's coffee is way too hot. I got a cup last week and it was almost 20 minutes before I could drink it. It was scalding.
Back to the question..... the driver who plowed into them was at fault.
