WASHINGTON - Unlike with food or medicine, the federal government has little to no power to make sure that the ingredients in your shampoo or other personal care products are safe. Regulators also can't force a cosmetic company to remove a product from the shelves if it's unsafe.

However, a new bipartisan plan in Washington aims to force companies to take cosmetics deemed to be unsafe off the market.

Miriam Lawrence's 9-year-old daughter, Eliana, had an adverse reaction after using a Wen hair product.

The third time Eliana used the shampoo, "Her hair slipped off her head on contact instantly," Lawrence said.

Eliana, now 11, is still missing about a quarter of her red curly hair.

Wen has received tens of thousands of complaints about its products causing hair loss, baldness and rashes. But the company isn't required to notify the government of "adverse reaction" reports -- even if someone dies.

U.S. Rep. Frank Pallone Jr., D-New Jersey, and Leonard Lance, R-New Jersey, unveiled a bipartisan proposal that would strengthen the Food and Drug Administration's authority to regulate cosmetic products.

Under the plan, which is still in the drafting stage, the FDA would have the power to review the safety of ingredients used by cosmetics companies and the ability to order recalls if a product turns out to be unsafe. Companies would have to prove that their products are safe before putting them on the market.

The FDA regulation would be funded by $20.6 million in fees levied on cosmetics manufacturers.

Lawrence says she was shocked regulations aren't already in place.

"I would never have guessed a shampoo would do that especially one that purported to be extra gentle and natural," she said.

For its part, Wen representatives say its products are safe and that the company is working with federal regulators.

In August, the FDA issued a safety alert on Wen products.

That is awesome- I too had issues with my scalp from this hyped up product, it took awhile to happen but eventually I ended up with hair loss and scabs all over my head, as soon as I stopped the product things started turning around and now almost 2 years later my scalp is back to where it was and my hair loss stopped- I made a formal complaint to the FDA, I just hope the product gets pulled, it is unsafe and I would definitely not use it on children

Poor thing, I wonder which natural ingredient (plant and food extracts) she is allergic to. Did her mother have an allergy panel done after this? I know of kids being allergic to grass, grass could you imagine?

Kids have allergies to things like nuts, honey, various plants and flowers. Most of these things are found in Wen. I hope her mother had her checked for allergies and didn't just seek payment.

I guess for her (and other highly allergic people) multi-chemical based shampoos are better than a more natural/plant based product like Wen.

What I find weird is "her hair slipped off her head on contact instantly" upon the third use. For her to have such a harsh reaction there had to be signs from the first 2 usages. Breakage, sores, irritation, redness, itching, etc. Why did her mother ignore the signs of an allergic reaction?

You can't get scabs without bumps and sores first. A scab is the body healing skin sores and irritation not the symptom. People that list scabs as the sign of issues are either ignorant to the body's mechanics or just trying to repeat what they have read.

As someone that frequently had relaxers and as such suffered true chemical burns, I can tell you the complete process from mild irritation all the way through to the eventual scab. A scab is NOT the first thing you would notice!!

Now you can have plaque dandruff or scalp psoriasis that feels like a scab...in which case I would recommend Wen Tea Tree and a visit to your doctor. Just make sure you aren't allergic to the natural oils and extracts first.

Sorry, but my sympathy goes out the window the moment someone says they won't be happy until a product is pulled from the market because of THEIR bad experience with it despite the FACT that millions of people have been using the product for years and years with not only no problems but with it resolving problems caused by other products.

I still believe that this has been an orchestrated assault on Chaz by a competitor.

The fact of the matter is, if EVERYONE who has a bad experience with a product demands that product be removed from the market and wins, there will be NO PRODUCTS left for anyone to use.

I'm not a skeptic by nature but I find it intriguing that these types of posts frequently appear just before a visit from Chaz. Coincidence? I think not..... The people who don't like WEN for whatever reason have failed to accept the fact that those of us that do like it will not be changing our minds. They are just wasting their time trying to persuade us otherwise. And it is a blatant attempt to hurt the sales of WEN. Sorry, not biting....... buying instead....

I mean, there are a few missing pieces to this story, including the actual stages of allergy or harm as you so clearly state. I feel for this child if this is what happened to her. This story is a bit much. I was allergic to all milk AND soy based baby formulas with multiple, immediate negative effects. I'm sure other kids were too. Can you imagine if ALL those products were taken off the market? Every last one? If you looked at my reaction, it would have been justified. However, if you look across all the children who consumed them, I was an anomaly, not a norm.

@arizona babe I had a horrible reaction to Pantene Shampoo...thick greasy scales, itchy irritated scalp, more-than-normal shedding. Should Pantene be pulled, too? My DH (and millions of other people) use it with no problems, so why take it away from them?

Millions of us use Wen with no problems--why take it away from us? If EVERY product that caused a bad reaction to some people was pulled from the market, there would be NO PRODUCTS left to buy!

Even "all natural" products have ingredients that SOME PEOPLE will have a bad reaction to.

It must FEEL really GOOD to "STICK IT UP" to us, dumb Wenners, @BExplorer. It must make them feel really good about themselves - they are smart and read the "news articles" and we are - stupid and do not know better, unless they "tell us"!

YESSSSSSSS - I can't wait to see his beautiful face, those precious Angels, and all of the healthy, bouncy, gorgeous Wen hair. I mean, assuming that the Wen doesn't cause people's eyeballs to fall out or skeletons to disentegrate right on stage. That could happen too, I suppose.
