Legal question(divorce)

Two people get married.

The man owns a home.

If there is a divorce in NJ and there is no prenup what happens?

Does the woman automatically get money from the guy?

I am watching a possible train wreck right now.

The guy is very naieve. (spelling)?

I would think that the person whose name is on the deed to the house would get the house. Isn't any monetary settlement determined by a judge? Length of the marriage might also come into play.

Whether or not the woman gets any money often depends on how long the marriage was. I believe in some states they only get alimony if married at least 10 years.

Your scenario is just too vague. Did the wife work and did they commingle funds? Or did she just stay home and be supported? Did they have any children?

As for the house ..... If, for instance, they added on another bedroom to the home, or made improvements jointly, she might have a claim. Or did he make 100% of the mortgage payments himself?

We can only theorize here .... too many unknowns.

Here in Texas it is called Right Of Reimbursement and does not matter how long you are married just how much was put into the home while you were married. It may be one spouse's separate property but most payments and upkeep ect.. come from the marital funds. The higher the equity in the home gets the better for the spouse who wants to be reimbursed.

I got my Right of Reimbursement much to his dismay.

Maybe there is something that I do not understand, but it seems to me that alimony is so unfair. Like a relic from the days that the the man in the family worked and the woman stayed home. Why should a man getting a divorce continue to pay for a woman's livliehood (sp?) when there is no reason that the woman couldnt put on her big-girl pants and get a job.

I think you're going to have to MYOB. At the most, perhaps you can suggest he see an attorney about a pre-nup, for the protection of both parties involved.

Yes that is what I have decided to do.

I was just wondering how it works because I know very little about these things.

Oh @Pqfan. If it were me, I would hope I would tell him - as unpleasant and uncomfortable as it will be. It is that important and you'd be looking out for him.

@PhilaLady1, I so agree with you about alimony. I don't think it is used much any more, for exactly the reasons you state. Just in extenuating circumstances (if the divorcing couple is elderly, for example).
