NJ Judge Has Ruled That Mom Can Keep Dad Out Of The Delivery Room.

The ruling was recently handed down in February say that the mother has a right to privacy in the delivery room in the case of Plotnick vs De Luccia. The parents to be are estranged and the mother sought the court action.

I agree with the ruling, what do you think?

I agree with the ruling. Childbirth is already a stressful and difficult time for the expectant mother and she should not be obligated or forced to have anyone in the delivery room that she doesn't want in there - regardless of whether they are otherwise on good terms or not.

Yes it is his baby too but, in this case It seems to be the best. The presence of the Dad could make her feel worse while in labor, such as her BP.

I don't think a woman should be forced to have anyone in the delivery room that she doesn't want to. That is an extremely stressful and painful time, why should she be forced to do anything?

Well, it says they are estranged. There has to be a reason for that. Maybe he's a jerk? Maybe she is?

Either way, he's not her husband/ significant other and she has every right to keep him out of any medical procedure.

I agree with the ruling.

The parents-to-be are estranged? Is he going to support this child and be in his/her life? If so, he has every right to be there at the birth of his child.

She can always squeeze his hand reeeeal hard whenever she feels pain..and curse him out like a famous comedian's wife did.

If they are estranged, that suggests to me there is tension between them. I feel the woman has a right to avoid potential stress during childbirth. So, yes, I do agree. The man should be notified asap of the baby's arrival, (or perhaps pending arrival, I'm not sure about that one, would she want to know he is outside, waiting?) So that he can come to the hospital an see his child as soon as he can. Surely the hospital has dealt with something like this before and can help them navigate the situation.

Absolutely agree with the Judge! I was separated from my first husband when I had my second child by caesarean section. It didn't go that far to have a judge's ruling. I told the doctor I didn't want him there, so he was not.

He has the obligation to support the child when it is born. He as a estranged spouse no longer has marital right to order his estranged spouse around. NJ law . I agree with the ruling.
