On 1/22/2014 sophiamarie said:
On 1/22/2014 BlueCollarBabe said:
Well, your husband is not a military law expert, is he? AWOL simply means not being where you are supposed to be, at the time you are supposed to be there. A military person can be one minute late for work, and be considered AWOL. A military person who is AWOL for 30 days or more is administratively classified as a deserter. Doesn't have anything to do with keeping your uniform nor your intent.

This is from the Uniform Code of Military Justice, Article 86, Absence without leave:

Any member of the armed forces who, without authority--

(1) fails to go to his appointed place of duty at the time prescribed;

(2) goes from that place; or

(3) absents himself or remains absent from his unit, organization, or place of duty at which he is required to be at the time prescribed;

While you are technically correct (and he's no military law expert), there is a lot of difference between what is written in the UCMJ and its practical application. As you said, a person who is late for work can be charged with AWOL, but will he be? No, because it's not practical on so many levels, including troop morale. But, in the case cited by the OP, the practical application is what my husband is familiar with, and he's only speaking from his own experience, not from the point of the worst that can happen to someone who violates military law. Thank you for your viewpoint, but this is as far as I'm going to comment on something someone else said.

Is this your version of a retraction? The military is nothing if not a stickler for "details".

I dated a man who admitted to me that he had been drafted and his unit was sent to Hawaii for "holding" before being sent to Viet Nam. On the day his unit was flown to war, he managed to take a plane back to NJ, went straight to Fort Dix and turned himself in. After a hearing, he was given a desk job where he completed his tour of duty. Every soldier in his unit was killed within the first month.

I know how I felt upon hearing this. How do you feel?

I was out marching with her as soon as she would let me.

One of my cousins was MIA - shot down over Cambodia - his body was never found, although he had told us he would take the cynanide capsule in the cockpit if he was ever shot down, so we knew he was gone, just never knew the exact circumstances. Another cousin made it back home safely - but he was the first of our relatives to agree with my mom!

He would have had transportation to the airport -- how does a serviceman, especially a greenie, manage that? And money. And some help in covering for his absence.

And he came from a family of privilege where their pressure helped him in court -- unless his immediate arrival at Fort Dix made the difference.

But then, had that got out, all kinds of servicemen would have done the same to avoid being killed.

I'm not saying this story can't be true but there has to more to it.

I'd want to know more details, such as how someone would slip away AWOL, get a plane, report to a military base, and avoid being arrested and jailed.

But I've worked with so many veterans and active-duty military, and I have so many in my family, so I have a concept of the terror many face along the way. So, I don't feel judgmental but I feel sad for the loss. The loss of all who have sacrificed for all wars.

Sick to my stomach, for all the soldiers in his unit who were killed. It was a stupid, pointless EXPENSIVE war, both in dollars and lives. A complete waste.

ETA: out here in the Pacific Northwest, there are a lot of Vietnam vets living in the forests. They were so damaged they couldn't adjust to "normal" society. They are the casualties too
