Class Action Lawsuits

Within the last few,weeks DD received a check in the mail for a class action lawsuit. This was a type of sales pyramid scheme while in college. The check was over $500. No postal date on envelope. Recipients given 60 days to cash with deadline of Dec. 20. This seems like a scam. How can they have such a short time to complete process with postal service being so erratic. When she called attorneys handling distribution she got response like "easy come, easy go.". No forewarning of check coming or followup.

Appears they want more to keep. I think inquiry with Attorney General for our State should be contacted. Bank says they will pursue and let her know if there are any fees or if it cleara.

Any experience with this?

Don't you have to JOIN a class action suit in order to get a reimbursment? (Like you have to file in a bankruptcy)...

Just call the state attorney general and they should be able to tell you if it is legit or not--

I've gotten a few emails lately of class action lawsuits for everything from LensCrafters to Verizon. Most of the time you have to opt out, as opposed to opting in. Meaning if you do nothing you get the share of the settlement. However, I don't understand what you mean by a deadline of Dec 20th being 60 days or that it's a short time to deposit / cash the check. Deadlines to deposit checks are very common.

Are you saying your daughter missed the deadline due to late mail delivery of the check?

She should take it to her bank and try to cash it anyway.

If they do not honor it, she should tell the company to reissue the check due to their late mailing.

Maybe the attorneys waited until the last minute, or perhaps they did it alphabetically very slowly.

Yes, I have received several very small checks for these types of settlements, and sometimes you opt in and other times you are just automatically included.

Yes!

While it could be a scam, I had the same thing happen with a very legit class action suit. The letter and check specified it was valid for only 45 days and afterwards would not be honored.

Of course, it got to me (it was sent to a previous address) after the 45 days had passed.

I called the law firm and they re-issued the check but they said to be sure to cash it immediately because the settlement account would be closed when the case and settlement were deemed paid out.

I guess a lot of people hold on to checks for long periods of time and then they misplace them. They seem to think the checks are valid indefinitely.

Putting a short timeframe on how long the check is actually valid for seems to get a lot of peoples' attention, so I guess it serves its purpose.

@Tori3569 You're absolutely right about deadlines to deposit checks being quite common, as I was just recently reminded. I received a check unexpectedly from a drs office for monies I'd apparently overpaid that stipulated it too must be cashed within 60 days. It was handwritten on the check lol. Hadn't seen this done in awhile.

I have received checks for class action lawsuits. I got five different checks from State Farm Insurance for five different accounts. The amounts were each in the thousands. I had to apply.

I also received a transfer into my PayPal account from the KEURIG K cup lawsuits. I had to apply and sent proof. The check was substantial, but not thousands. I just got most of my spent money back.

I have never received a check from a class action lawsuite that I did not apply for that was for more than $5 or $10.

I would deposit the check, but not spend the money until the check cleared. Sometimes, class actions are done on our behalf if we don't opt out, but I personally have never received $500 or even close to that for those types of suites.

I read somewhere that 95% of all checks issued are cashed or deposited within 5 days.

It is assumed that after 30 days it probably won't ever be cashed, but I think the minimum end time was 45 days in most states. The longer they go uncashed, the more likely the checks are lost or misplaced.
