Update on Martino Cartier's Lawsuit Against HSN

The current thread on Dennis Basso made me wonder what has happened with Martino's lawsuit against HSN following his being banned from appearing because of alleged inappropriate touching and intoxication.

HSN tried to have the lawsuit dismissed based on three issues. This information was presented to the judge and his decision was published on May 23, 2023.

-Martino is a public figure and therefore has to prove HSN acted with malice to defame him. He did not prove malice. The judge decided that Martino is not a public figure in this case (that must have been painful for Martino to hear) and does not have to prove malice. The defamation suit can continue.

-If HSN did not defame Martino, then they did not illegally interfere with his contracts with vendors. The judge said the interfering with contracts suit can continue.

-Martino claimed HSN intentionally inflicted emotional distress by their actions. The judge said the claims presented did not reach accepted definitions and blocked this part of Martino's lawsuit from moving forward.

@PickyPicky3. This is all very interesting but I never heard of this Martino so he's definitely not a public figure (sorry Martino). However, it sounds as though he might have been a lot of fun to watch on TV. What was his product?

@Kachina624 Martino Cartier is a hairdresser in Southern New Jersey near Philly who was the demonstrator of Gabor wigs.

I bought a Martino blow dryer from HSN about 5 or 6 year ago and it still works good.

Edited to add, it was probably more like 10 years ago.

Also, when the folks here were discussing the incident when it first happened, there was a TS. I watched the video and can't be sure if Martino was tipsy or not. It was midnight, and he may have been jet lagged or just tired. In my opinion, I saw nothing too handsy or inappropriate. I don't see that from Dennis, either. Fashion and hair are a hands-on business.

I vaguely remember him on HSN, and that's because someone Jogged my memory by saying that he was a hairdresser.

Sorry Martino, you are not a public figure if people do not know who you are.

I never heard of him until today, but he won HSN's Entrainer of the year, he'd has also been featured on Bravo where he gathered millions of fans. He and his salon have been featured in Vogue, Modern Salon Magazine ad The golden Globes. He and his team have been featured at all 5he modern hair shows in an. America including The z stylists Choice Awards in Chicago. I don't know how he is not considered a public figure. i went to his website to check him out and this is where my information on it comes from. If someone makes regular visits publicfigure.on broadcast television, I think they become a public figure. The PF status might vary by jurisdiction, though.
I did find the case and my idea of what a public figure is is not their idea.

I also was surprised how the judge made his decision about Martino's non-public figure status, but we learn something new every day. I also substituted the word "illegally" for "tortiously." They're not exactly the same.

My understanding is Martino is not doing as well financially and had to relocate his salon to his home.

i know who he is and have purchased items he represented on HSN.

i always liked him and he had a ton of energy.

he used to represent amika hair products and appliances. i have 2 blow dryers that were on the expensive side, but still going strong. there were also hair products that worked well in my hair.

I'm glad to see that Martino can continue his lawsuit on several legal grounds.

I hope that he prevails and takes as much as possible from HSN-Qurate for the accusations against him, which I believe were meritless and manufactured.
