Harvey Weinstein Guilty of 2 Out of 5 Charges

Harvey Weinstein is guilty of 2 of the 5 charges he faced in his NYC criminal trial -- but he was found not guilty on the charges that could have put him in prison for life.

The jury found Weinstein guilty of 1st-degree criminal sexual act and 3rd-degree rape.

He could get up to 25 years in prison just for the criminal sexual act. However, the jury found him not guilty on 2 counts of predatory sexual assault charges. Those carried a possible life sentence. He was also acquitted of 1st-degree rape.

A jury of 12 people -- 7 men and 5 women -- finally reached their verdict after 5 days and about 22 hours of deliberations. This comes after an interesting turn on Friday ... when the jurors sent a note to the judge asking if they could be hung on 2 counts of predatory sexual assault and unanimous on the others.

The judge told them to go back deliberations, and they worked it out by Monday morning.

As we reported ... Weinstein pled not guilty to 5 felony charges relating to sexual misconduct. The charges were based on the accounts of 2 women ... Miriam Haley, a TV and film production assistant who worked on "Project Runway," and former actress Jessica Mann.

The prosecution rested its case 2 weeks ago after 12 days of witness testimony. In total, 6 women testified against Weinstein, including Haley and Mann. Last Tuesday marked the start of jury deliberations.

@TVLand I read it was so that he would appear to be a harmless old man. There are pics of him without the walker. Who knows. Just what I read.

He is a monster and deserves every minute he spends in jail. I hope the survivors of his rape and assault can experience some measure of peace.

His behavior was disgusting. All of Hollywood knew what he was doing and he got away with it for many years. It's about time some measure of justice was done. His "disability" is absurd. I'm glad the jury didn't fall for it.

He was found guilty of some things and no doubt he IS guilty of those things.

But it's hard to sell a first-degree rape charge when the "victim" says

Weinstein is her "spiritual soulmate" and admits "to having on-and-off consensual sexual encounters with Weinstein for years."

So maybe not a pound of flesh, but something at least.

OK, I confess I haven't followed this case closely. So maybe someone can enlighten me (and be gentle)

I realize the case goes back for years but didn't one of the more recent victims think to audio record the circumstances on their smartphone? At least to prove they said "NO" or even provide some commentary? ("Put that back in your pants" or "Leave that poor plant alone").

Seriously, I'm 66, wellll before smartphones and knew if a date was going south. I would think modern women with smartphones (especially in the entertainment field) would be well aware of HW's reputation. I'd be wearing dresses, skirts, pants with pockets around someone like that to keep the phone handy.

I am NOT blaming the victims: just a little puzzled at why they didn't protect themselves a bit.

DH and I are childless by choice, but have occasionally talked about what we'd would have done with "our children". DH has said more than once HIS daughters would have black belts and Harvey would need more than a walker.

He deserves to rot in prison for the rest of his miserable life. The walker is to get sympathy. Perhaps his lawyer will make a plea on Fox and get him a pardon.

Nice that the old song and dance isn't working anymore. "But she was smiling in a picture!" "She said something nice!" Resilience and various methods for coping with a crappy situation can't be used against survivors so easily anymore.

In ancient times, the only time the public believed a woman was assaulted was if she killed herself afterwards. That was the only way people thought she could prove she was actually traumatized.

We know now that people react to trauma in lots of different ways. PTSD survivors from the military, for example, still can manage very well but that does not detract from the initial injury and the challenges they face.

I'm 70 and when I grew up, going to a hotel room meant only one thing. These women wanted work and as horrible as his behavior was, they kept going back to him. This was a quid pro quo. Both sides got what they were looking for. Too late now to complain.

It's okay. If they feel safer by thinking nothing can happen to them because they are smarter and more worldly wise and virtuous than the rest of us, bless their hearts. I hope they never find out otherwise.
