NY STATE TAXES

recently upon closer look on a refund I recieved from QVC I felt I was shorted. Called up QVC and rep said my NYS tax was not refudned to me cause it was paid to NYS. When I go to a store and return an item I also get my tax back full amount of payment paid. Okay I can see S&H kept but not tax for no item. I then called NYS Dept of Taxation and they said I can get a refund for my taxes paid out on returned items. You must file a AU-11 Form and can go back 2years from date of purchase.

At least HSN refunds our money. QVC use to I believe till they started getting too big and have changed drastically from their LOGO of what it use to stand for.

So if you live in NYS this is worth the effort and if you live out of NYS check your Dept of Tax and Finance Dept for your state.

(I also don't feel its right they charge less initially for S&H and 6.95 for return ...I think it should be the same amt you were charged for to ship...but thats another ball of wax)

if the customer service reps say they cannot, then direct them to the general terms and conditions of qvc. if that doesnt work, i would suggest emailing qvcsocialteam@qvc.com. include the quote and the link to where the quote can be found on the qvc website.

QVC definitely has a problem with collecting state sales tax. I live in PA. We have no sales tax on shoes or clothing, unless,it is formal wear or,sports equipment.

QVC charged me tax on two pairs of sketchers with faux fleece lining, a slipper type of shoe. They claimed they were fur lined and tax is due on fur items.

I went round and round with them on this issue and even reported them. Finally, I had to fill out a form to get my tax back from the state.

Now I only order on line and check to make sure the tax is correct before I order. If not, they lose a sale.

I keep hoping someone will file a class actions against them. This business practice is unethical at best.

QVC could learn a few things from HSN, at check out the tax drops off for non-taxable items. I live in the state of Massachusetts.

That's one of the most ridiculous things I've heard in a long time. That's like saying we can't refund your money because we've already paid the vendor.

I agree and when I returned items and checked for my credit - always felt I wasn't getting my full due. (NYS taxes)

Point #2 - if Q can ship TO ME for $3.50 - why can't the return cost the same?

Now I just try NOT to order much............don't feel Q is giving us a fair shake.

QVC's accounting and tax software must be pretty bad.

If they pay NYS sales tax collected on a quarterly basis, as do most vendors and retailers, there is a line item for credits on returned merchandise.

So they could easily return the sales tax to a customer themselves. and take a credit on their next quarterly tax payment to NYS.

Sounds like they're playing the investment float with customers' money.

I file NYS Sales tax for two of our companies and yes there IS a line to deduct for credits and refunds.

Having said that, I live in NYS.

I have ALWAYS had my sales tax refunded on sale price adjustments AND returns. I have shopped w/ Q since CVN. Have never, ever had a problem.

If you are not, you should as previously suggested contact the mods.

C/S reps are not versed in tax law and the one you spoke with is ill trained! Don't accept that answer, it is wrong.

I wouldn't waste my time filing for a sales tax refund with NY as an individual. Too much garbage to go through! I would push the issue with Q.

I live in Philly and whenever I received a refund on taxable items from QVC I've always received back the tax I paid. I would contact the Mods. The CS rep is wrong. You are supposed to get back what you paid - this includes taxes (minus any shipping charges). It is illegal for you to pay taxes on merchandise that you returned.

I pushed my issue with QVC and got no where with them. I even reported them to the PA Attorney General's office. I got a letter from QVC and one from the AG's office saying there was nothing they could do. QVC wouldn't budge. QVC said they are correct to charge tax on fur items...even cheap polyester fur lining.

I posted on the forum asking the mods to help...no one responded.

No one is going to push the issue for a few dollars. This will only stop if there are multiple people involved showing that this is a big problem that QVC is aware of and is ignoring the issue. perhaps a class action.

But I think that is a sllightly different situation

They are disputing charging taxes because of the fabric content and whether they interpret the law that they should.

This would be about sales tax on an item returned, that you don't even own anymore.

My GF was a comptroller at Perricone before they closed the CT offices. She was the one that filed sales tax in every state required AND overseas. It was a nightmare she said keeping all the 'rules' straight for every place! Not only are there 50 states...but all the counties have their own laws!

@RespectLife Regarding price adjustments and sales tax. QVC SHOULD give back the difference in sales tax as that is only fair. Sometimes I get it, but more often than not, I don't. I have had more than one CS person tell me that they don't give back the difference in sales tax. A few other times, they automatically gave it to me. That is just extra cash in the QVC pocket because I am sure the tax had not been paid to the state at that point, and if it had, it could be adjusted for the next month payment.

BTW, our company pays sales tax every month, not quarterly. We are not in NY, so probably every state has different requirements.

@RespectLife It's a very different situation that the OP posted, but shows there is a problem at QVC with collecting taxes.

I was told that I shouldn't be so upset because QVC didn't keep the money. They turned it into the state. They probably told the OP they same thing. That sure didn't make me feel any better.

I would suggest never ordering anything from QVC that has even a remorse chance of needing to be returned. Saying they will refund the tax but putting the burden on the customer to have them follow through is absurd.

You could report it to the state of PA where they do business and recide. I am sure the customer rep was wrong. That just sounds odd. I have been shopping here at qvc since 1989 and on the boards since the early 90's, I have never heard od anyone mentioning this on the boards. Please follow up. This is wrong.

Oh I would be upset! Especially since you know you are right.

I know that 50 states, thousands of different county tax laws, individual territories is a monumental situation.

Still, they should have the ability with their supposed 'advanced' software to abide by the correct laws in each state, in each county.

While I realize QVC isn't keeping the tax amount the LAST thing I want to do is give NYS any MORE of my money than I have to! They get ENOUGH!
