      <title>NY STATE TAXES</title>

      <description>&lt;P&gt;&lt;FONT size="4"&gt;recently upon closer look on a refund I recieved from QVC I felt I was shorted. Called up QVC and rep said my NYS tax was not refudned to me cause it was paid to NYS. When I go to a store and return an item I also get my tax back full amount of payment paid. Okay I can see S&amp;amp;H kept but not tax for no item. I then called NYS Dept of Taxation and they said I can get a refund for my taxes paid out on returned items.&amp;nbsp; You must file a AU-11 Form and can go back 2years from date of purchase.&amp;nbsp; &lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="4"&gt;At least HSN refunds our money.&amp;nbsp; QVC use to I believe till they started getting too big and have changed drastically from their LOGO of what it use to stand for.&amp;nbsp; &lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="4"&gt;So if you live in NYS this is worth the effort and if you live out of NYS check your Dept of Tax and Finance Dept for your state.&amp;nbsp;&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="4"&gt;(I also don't feel its right they charge less initially for S&amp;amp;H and 6.95 for return ...I think it should be the same amt you were charged for to ship...but thats another ball of wax)&lt;/FONT&gt;&lt;/P&gt;</description>

      <description>&lt;P&gt;QVC definitely has a problem with collecting state sales tax. &amp;nbsp; I live in PA. &amp;nbsp;We have no sales tax on shoes or clothing, unless,it is formal wear or,sports equipment.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;QVC charged me tax on two pairs of sketchers with faux fleece lining, a slipper type of shoe. &amp;nbsp;They claimed they were fur lined and tax is due on fur items.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I went round and round with them on this issue and even reported them. Finally, I had to fill out a form to get my tax back from the state.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Now I only order on line and check to make sure the tax is correct before I order. If not, they lose a sale.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I keep hoping someone will file a class actions against them. &amp;nbsp;This business practice is unethical at best.&lt;/P&gt;</description>

      <description>&lt;P&gt;&lt;FONT size="3"&gt;I agree and when I returned items and checked for my credit - always felt I wasn't getting my full due.&amp;nbsp; (NYS taxes)&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&lt;FONT size="3"&gt;Point #2 - if Q can ship&amp;nbsp;TO ME &amp;nbsp;for $3.50 - why can't the return cost the same?&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&lt;FONT size="3"&gt;Now I just try NOT to order much............don't feel Q is giving us a fair shake.&lt;/FONT&gt;&lt;/P&gt;</description>

      <description>&lt;P&gt;&lt;FONT size="3"&gt;QVC's accounting and tax software must be pretty bad.&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="3"&gt;If they pay NYS sales tax collected on a quarterly basis, as do most vendors and retailers, there is a line item for credits on returned merchandise.&amp;nbsp;&amp;nbsp;&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="3"&gt;So they could easily return the sales tax to a customer themselves. and take a credit on their next quarterly tax payment to NYS.&amp;nbsp;&amp;nbsp;&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;FONT size="3"&gt;Sounds like they're playing the investment&amp;nbsp; float with customers' money.&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;I live in Philly and whenever I received a refund on taxable items from QVC I've always received back the tax I paid. I would contact the Mods. The CS rep is wrong. You are supposed to get back what you paid - this includes taxes (minus any shipping charges). It is illegal for you to pay taxes on merchandise that you returned.&lt;/P&gt;</description>

      <description>&lt;P&gt;I pushed my issue with QVC and got no where with them. &amp;nbsp;I even reported them to the PA Attorney General's office. &amp;nbsp;I got a letter from QVC and one from the &amp;nbsp;AG's office saying there was nothing they could do. QVC wouldn't budge. QVC said they are correct to charge tax on fur items...even cheap polyester fur lining.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I posted on the forum asking the mods to help...no one responded.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;No one is going to push the issue for a few dollars. &amp;nbsp;This will only stop if there are multiple people involved showing that this is a big problem that QVC is aware of and is ignoring the issue. perhaps a class action.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;But I think that is a sllightly different situation&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;They are disputing charging taxes because of the fabric content and whether they interpret the law that they should.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;This would be about sales tax on an item returned, that you don't even own anymore.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My GF was a comptroller at Perricone before they closed the CT offices.&amp;nbsp; She was the one that filed sales tax in every state required AND overseas.&amp;nbsp; It was a nightmare she said keeping all the 'rules' straight for every place!&amp;nbsp; Not only are there 50 states...but all the counties have their own laws!&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

A few other times, they automatically gave it to me.&amp;nbsp; That is just extra cash in the QVC pocket because I am sure the tax had not been paid to the state at that point, and if it had, it could be adjusted for the next month payment.&lt;/P&gt;</description>

      <description>&lt;P&gt;BTW, our company pays sales tax every month, not quarterly.&amp;nbsp; We are not in NY, so probably every state has different requirements.&lt;/P&gt;</description>

      <description>I would suggest never ordering anything from QVC that has even a remorse chance of needing to be returned. Saying they will refund the tax but putting the burden on the customer to have them follow through is absurd.</description>
