Divorce/custody questions

First of all, I am aware it is best to hire a lawyer in cases such as divorce or custody. However, my son is looking at an online site called Father's Custody Advocacy (not sure if this is exact title) and can, for a small price, get advice on how to begin. His wife and my son have been separated for about 8 years, but never divorced. they have one child. The child has gone back and forth between them (my son lives with me) during those years. We learned recently the wife has been living with another man and has two small children with him. The child was told to be quiet about it, and was until recently. She is now living with us and going to a school around the corne The mom wants her back. My son is fed up and ready to begin proceedings. The child wants to live here. What do you think of online sites? At least to get advice? I, myself, had a problem a few years ago when I did Legal Zoom, so I am skeptical. Thanks.

I would not trust them for something involving child custody.

I would say absolutely not when it's regarding custody of his daughter. Better to spend that money on a good attorney.

Your son should retain an attorney who specializes in child custody issues and not from an online advocacy group.

If they have never divorced, he may be responsible for the other two children. I hope that he will seriously consider counseling for his daughter. She has been carrying a heavy burden of secrecy in addition to being in a tug of war between her parents. He needs to see a lawyer now. Good Luck!

@chihuahuamom your son should go see an attorney. Many have initial consults for free. Legal Aid is a great resource too.

Having been a legal secretary for many years, it's highly doubtful that the son would be "responsible" for the wife's other 2 kids.

She is openly living with another man, other people know he is the father.

He needs a good family law attorney YESTERDAY!

I suggest your son pay that money to someone local he sits down in front of for the solid answers that pertain directly to his situation.

That is not correct and it is quite likely. Each state has their own laws on this.

In regards to custody I highly suggest an attorney who specializes in custody/child/divorce issues.

Forget the online sites. Whatever he'll end up paying them, should go toward hiring an attorney. He'll end up hiring one in the end

I agree totally. He needed to get an attorney years ago when they separated. Find the money and get an attorney.

Why on earth isn't your son divorced? Story sounds odd to me. If he is an employed adult with a child it seems he should have his own residence. I feel sorry for the child.

retain an attorney. My DD did this years ago. It was hard fought and expensive but worth it.

The other 2 kids belong to the "boyfriend," not the OP's son. No way is he responsible for them.

One of my co-workers lost his children because, "even though the wife and man were not married, it was a more normal atmosphere for children.!"

Yep, that's what the Judge ruled.....unbelieveable but true!

I would go to an atturney face to face. If she is not abusing the child they will most likely get joint custady. She is moving on with her life. Nothing wrong with that at all. It sounds like your son is acting jealous which is most likely why she wanted the child not to mention she is living with her boyfriend. Perfectly normal for her to live with him if she had kids with him as well. Sounds like she is moving on with her life and he is not. Sorry but unless his son is in trouble no judge will give him sole custady. If he has a concern he should hire a private investigator to look into her relationship with her current man

@chihuahuamom, is your granddaughter at the age where a Judge would ask where she wanted to live? If the boyfriendś name is on his children birthcertificates, the estranged husband would not be held responsible for them.

It sounds like this child is surrounded by the love of his dad and his grandma.

Pretty wonderful, IMHO. Chances are grandma helps with child care while dad

works. Who’s to say? It sounds like they are trying to do the best they can and

reached out for advise, not judgement.
