topic Seeking help for Dell Laptop from QVC in Electronics

My QVC-purchased Dell laptop 1545 Inspiron bought in December of 2010, quit week before last; I ran the self-repairs, no luck. Finally called Dell tech support and hours and hours on the phone with numerous tech supports with heavy foreign accents told me the hardrive is defective and would send me a NEW one within 2 days. Well, it did come, but instead it is REFURBISHED not NEW. The warranty on QVC website reads Dell reserves the right to send either a new or refurbished one. I called Dell and they told me all defective hard drives will be "refurbed" because "their technicians open and check the drive, so it is not new, you see" What?!!? I want a new one, not a refurb after hours and hours on the phone, and lost time on this product. I've contacted the QVC folks and we'll see what happens from here. Any thoughts/suggestions?
