Any proceeds from a class-action suit after legal fees, whether through a judgment or a settlement, are shared among all members of the class.

Key Takeaways

A class action refers to a legal course where the plaintiff brings forward a lawsuit for the benefit of a larger group of affected people.

This group, or class, must attest that they were affected by the defendant's actions, but only the lead plaintiff will try the case in court.

Class actions are often the only way for individuals to pursue their claims as it lowers the cost of the legal pursuit.

If the plaintiff wins, awards are paid out among members of the class, though not necessarily in equal amounts.

In finance, class-action lawsuits are often brought against companies where the class is the company's shareholders.

Source: Investopedia

Not every proposed class action will become a class action officially, and it may surprise you to learn that there’s a fairly high bar to meet before a case can be certified as a class action—a critical step in the process between a lawsuit’s filing and its potential resolution. In general, failing to meet the certification hurdle can doom a proposed class action for good, but if certification is granted, the plaintiffs’ lawyers are that much closer to a favorable outcome.

So, what’s the recipe for a successful class action lawsuit? Well, it’s all laid out in what’s known as Rule 23 of the Federal Rules of Civil Procedure. Below, we’ll break down the Rule 23 requirements that every class action must meet in order to pass that formidable certification stage.

But, before we go on, it’s important to note that if you’re considering filing a class action, it’s a good idea to seek the advice of an attorney first. Though we’ll do our best to outline what’s required, an attorney would be better equipped to help explain your legal rights and options and determine whether a class action would be appropriate for your situation.

That being said, let’s get into it.

Rule 23 requires that in order for a lawsuit to be certified as a class action, the class must be “so numerous that joinder of all members is impracticable.”

In other words, the proposed class must include enough people that it would, in practice, be difficult or impossible for each of them to represent themselves in a lawsuit together. In situations like this, it is more appropriate for one or a few people to represent the entire group—which is the whole purpose of a class action lawsuit in the first place.

Some courts have considered the class to be “numerous enough” when it contains at least 40 people, but others have held that factors such as where class members are located, how easily they can be identified, and the size and nature of their claims must also be considered.

Classaction.org

I have no lawyers in my family, but I know what a Class Action Lawsuit is and what it is not.

kind of like deja vu?

A lawsuit claims products made by luxury brand Olaplex left customers with damaged hair, bald spots and blisters.

In the lawsuit, filed on Feb. 9 in California, Auriana and more than two dozen women across the country claim they have been left with hair that is worse off than before they used Olaplex products.

They claim in the lawsuit that Olaplex hair products they used left them, in some cases, with bald spots, allergic reactions, open sores and hair that is "dry, brittle, frizzy and dull." One plaintiff claims in the lawsuit the treatments made her hair look "as if it were cut with a weedwhacker."

Collectively, the plaintiffs are seeking more than $75,000 in damages.

I saw this on the news tonight. I have some Olaplex items that I got in the GWP bags that QVC and HSN have done (for cancer charities).

I haven't used any of it, but I think I may just toss it. No point taking the chance on a product I wouldn't have used otherwise.

I use Olaplex, but only 0 - 3. Never had a problem with it and I can definitely tell the difference when I use 1 & 2 when I color the 1st time after a perm. I don't use the other products, and I wonder if the plaintiffs left it in too long as I know a lot of people think of it as more of a deep conditioner and longer is better than what it is actually meant to do. Almost all the other numbers contain silicones and other ingredients that can build up on hair, so I avoid them.

I recently added the K18 mask to my routine switching it out with Olaplex 0 & 3 and I have been really happy with that product too. Gives my curls more definiton and bounce and I have better 2nd day hair after using it.

I've got very dry hair with lots of gray now mixed in. I started using Olaplex No 6 Bond Smoother Leave-in Reparative Styling Creme about 5 years ago and love it. It really tames my hair and gives me the moisture I need. I've not used any other products from them and use this No 6 at the direction of my hair stylist. I'd like more information on what the suit is about, I don't put this product on my scalp. Just from reading this post and not reading the suit, it seems WEN has continuing complaints that sound very near to what these are. Very interesting and will follow.

Two dozen women across the country is really not much. And as for the one who claimed her hair looks like it was cut with a Weedwhacker, how could a shampoo affect the cut?

I use Olaplex. I don't find it any better than any other shampoo/conditioner. My hair is frizzy and dry in the front, but I can't blame Olaplex.

I'm surprised. I am very sensitive to chemicals, and had huge amounts of hair loss with Wen. I even got a few bucks back with the class action lawsuit. That was bad for my hair and scalp! I use Olaplex #3 and the deep conditioner, that you can only get the beauty supply stores. I have not used the shampoo or conditioner. Both my husband and myself have had great results. No hair loss, no damage. In fact, it's saved my hair is I'm trying to grow the layers out and the ends can be very brittle. So I'm surprised that people are having such a difficult time with it. I guess everyone's body chemistry is different.

I was considering trying it, gotta rethink that now. Also, I don't think their "numbering" of the products is very user friendly. I've been happy with Paul Mitchell's lavender mint line & recently added Amika soul food mask which I'm loving.
