topic Received USED product in Beauty

Having won bids previously on EBay, I bid on a Simply Ageless compact and won it at a good price. It arrived yesterday and my fault for not having taken a better look at it...I gave a postive Feedback to the seller. Later, when I took a better look, I found that this wasn't sealed and that it had already been used - the sponge applicator had makeup all on it. This is the first time I've ever had this to happen. I immediately wrote the seller asking for a refund or a replacement and she replied that she had no more of this particular shade but when she got anymore in, she "Promised" to replace it.....I really want the product but I have my doubts that she is really going to send me another - I feel this will long be forgotten after a few weeks. Any opinions as to whether to wait or go ahead and get my refund???
