I bought a Calista Perfector on Ebay and it does not work. The seller is ok with me returning (she is paying return shipping), but should I have to pay the original ship charges? Shouldnt that the credited back to me. This clearly was a defective item...

I have neer returned an item on Ebay so not sure how to handle this.

If item was defective, seller should make you whole, i.e. return the original shipping. An item has to be 'significantly not as described' (not just returned because buyer did'nt like it, etc.) in order for buyer to collect original shipping. Remember, that money went to the post office, profit for the seller, so it's going to come out of seller's pocket--but if item is clearly not what you purchased (i.e. a functional Perfector), then yes, seller should return everything you invested.

Even though the seller is being agreeable right now, I personally think it's best if you follow eBay's method of opening a case in their Resolution Center. That way it's all documented and the seller can't change her mind. You will be assigned a case number. When you return the item, you will be obligated to purchase delivery confirmation and list the tracking number. When delivery is verified, your original shipping will be included with the refund - eBay will see to it.

You know, I would contact the seller again and tell that person that most places refund 100%, before I'd get the Ebay resolution center involved. If you have a good repoire with the seller, they may do that voluntarily. Getting the resolution center involved right away sends the wrong message sometimes to a seller that just may do what you want after you e-mail them. If you get any guff then I'd go to the Res center and start a claim. If a seller is worth their salt, they will make it right. Dealt with a couple sellers that were rip offs but did get the Res center involved and all got taken care of. Also have dealt with a few sellers whose items were faulty and after contacting them, got what I wanted and they got a good feedback from me.

I have bought and sold on ebay for well over 12 years. In my experience, the majority of people are honest and trustworthy. Sure there have been a few that were not, but that is when I've contacted the ebay resolution center. To be quite honest with you, according to ebay, you will be reimbursed the original shipping and purchase price. As for the return shipping, sellers are not required to reimburse that. Even though the item was clearly defective you are responsible for it. I as a buyer have had only one seller reimburse me for the return shipping on a defective / not as described item. As a seller, I always reimburse if the mistake is mine. As for documenting what is agreed upon in advance~as long as you do ALL correspondence through ebay messaging~you will have it if you should need it at any point. Also, because you are returning the item, while the seller will lose the money she paid on shipping , she will be able to recoup her fees from both ebay and paypal. Good luck and I hope this helps.

Do all of your negotiations through the Ebay system. File the complaint through Ebay. Go through all of the steps, and Paypal will refund you in about 2 weeks.

This is the ONLY WAY to assure you will get your money back.

Also, leave good feedback if all goes well with the return. It is not the seller's fault if a product is defective, and you promptly get your $$ back.

Okay, I stand corrected. From the ebay site:

Here's what we found for "Who pays for return shipping of an item?"

-
In most cases, the buyer pays shipping when returning an item to a seller. There is an exception however. Sellers pay return shipping if an item doesn't match the listing description and the managed return process is used. Buyers usually pay return shipping if they change their mind about wanting an item and returns are covered in the seller's return policy.

It's sad, ibb! Buyers don't understand how negative fb can truly hurt a seller. They don't understand the sanctions ebay can place on a seller's account.

MrsCat, I'm very glad that your seller was honest and made you whole. She not only lost on the $$$ she sent back to you, she also lost on fees she had to pay to both ebay and paypal. I hope you will take the time to leave her POSITIVE FB & all 5 STARS!

I have purchased almost 300 items from Ebay & have 100% feedback. I always make sure I know the seller's policies before purchasing.

IT HAS TO BE POSITIVE according to ebay rules. At one time in the past a buyer's fb meant something. Now, not so much.

If an item is defective or damaged, the seller/retailer IS responsible for the return shipping! Some will send a return label and some will refund 100% upon receipt of the defective item!

And some actually don't want you to return it and will just refund you the purchase amount and original shipping.

kcladyz - Wrong again #458 times! Even QVC will refund all shipping charges...if an item is defective.
