It can be both. This is definitely a decoration my neighbors up in NY would have on their porch or lawn.

I think they should sell it. If someone doesn't like it, they don't have to buy it. I wouldn't have had the nerve to complain about it. Is that lady going to contact every store that sells it or a similar item?
