Re: Having a family member file for disability and declared incompetant++

I have a friend who is/was an atty.  She struggled for *years* to get SSI for a debilitating medical condition, being her own legal advocate, staying on top of paperwork, filings, etc. She only got it once she went to a specialist atty.

When my mother received it a hospital social worker filled it out. She had it in a couple of weeks (was even given some temp aid inbetween) but she was really ill at the time. The social worker told her it processes faster if you have actual medical people backing you up, especially medical social workers. So if can get his medical team, anyone from his team invovled it helps with the process and they will find the right person to help you through the process.  A lawyer may be good if he was hurt through an accent but unsure of how they would help if its a medical/disease concern. I'm a nurse and TBH its very hard to get SSI for anything other than physical illnesses. If he has been seeing a psychiatrist or anything along those lines they can also help him attain it.

You want lawyers like Binder & Binder that specialize in this.  The fees are statutory.

Do the math.

@Kachina624 This was mentioned to me (about getting it to go through much faster). Would this be a disability lawyer? Would this person handle trusts and such for him for down the road? Going to court to handle the incompetency ruling/paperwork?

Yes,  many lawyers specialize in helping people get disability payments.   They are all probably okay because they only get paid (%)  if you get the benefits.   I'd assume they do other work but that may depend on how busy they are.

It looks like I will need to this for one of my children. I am lost when it comes to SSI, disability, the paperwork and the SS office near me is USELESS. I've been to different websites... I think I need professional assistance with the situation.

So, is there a specific type of lawyer I should find who can handle this? Specific group that I can contact to give me guidance? He will be living with me for the rest of his life (most likely) and I want to do everything I can to assist him in any way.

Thank you for any information. To say this is breaking my heart is an understatement.

@SahmIam, I have it for DD.  I filled out the paperwork, made an appointment at the office and started the procedure.  I was told from the start  by the gal at the SS office if she was denied, appeal, that it isn't unusual to be denied.  Luckily we weren't and she got it.   If you've already looked at the paperwork and gone into the office with it completed and were at a loss, by all means hire an attorney, but if you haven't, it may be worth doing that before going to that extra expense.

To answer a few questions:

There is no social worker involved; I have been his advocate and handling EVERYTHING for him since he was 13 and the incident occurred. His neurologist will fill everything out, no problem; his pediatrician (who has been there since the start and handles all his Rx's locally) will see him until age 26  and help out with any paperwork necessary.

There is no one "responsible" as it was simply an accident in everyday life that did the brain damage which has lead to other medical issues and going forward, between the heavy and multiple pills he must take to function and the short term memory loss (not related to the drugs), he is going to have to have assistance in many ways.

I know there is far more to just filing for disability with SS; there is housing allowance, medical care costs after the age of 26... I've been told that I can receive financial benefits for being his caregiver (that SHOCKED me), help finding support groups for him or maybe a little job for a few hours a week so he can socialize in some capacity... things like that. I'm just.... overwhelmed and well.... need help here.

Thank you for your kind wishes and suggestions; it means so much to me. ANY info helps.

@SahmIam, I understand it is very overwhelming.  Does your son got to school? Any kind of program?   I would be happy to pass on any experiences I have had if you want to privately email?
