Normal in a high profile case. This way all the Tony Stewart haters can't lay blame on the poor DA when he doesn't file charges. we have seen here on this BB how over the top irrational some of the people here can get.

The DA's office job is to present the evidence to the grand jury. He is acting as the prosecutor before the grand jury as they determine what (if any) charges to place.
The grand jury will be the ones handing down an indictment indicting (filing charges). The DA will be presenting the evidence & the possible charges they can indict him on.
He could have just said that upon review, there is no basis to charge him with anything. That would have ended that. It happens all the time when DAs don't think they have enough evidence to make a case. The DA didn't do that.
He is continuing the case...

DAs have to be re -elected. A local boy died. I honestly think there is no evidence to support bringing charges but the DA has to cover his behind because it will come up at election time if he doesn't.

FYI - The driver was from about 2 and a half hour's drive away from Canandaigua NY. He wasn't a "local boy." He was from upstate NY, but didn't live in the county where the track is located. He wasn't "local" as far as the DA and his potential voters were concerned.

Because he didn't just press charges himself? Because he didn't just exonerate him?
Now he will be acting as a prosecutor, presenting the evidence and the case to indict to the grand jury for their vote.

I would think this is just a formality and is being done because of the high case profile. I doubt Tony will be indicted by a grand jury. JMO. It was an accident that was created when a young man chose to leave his car and run on to the race track.
