Are firepits legal?

My neighbor is constantly burning stuff in his firepit. I am sick to my stomach and have a headache when he is using it. The smoke is obnoxious to say the least. I lie in bed with the windows closed, and I still smell it. Are they legal? I live in PA.

They are where I live. Lots of people have them.

I've never heard of them being illegal anywhere.

I wish they were illegal. I have asthma and everytime my blankety blank neighbor gets one going 'til all hours of the night, I can smell the smoke in my house, and it makes me have an asthma attack, I have to use my quick acting inhaler. :-(

We bought one about a month ago from Walmart.

We love it and are heading out in a bit to sit by the fire.

I have not heard anything about them being illegal.

If they were, why would they be sold?{#emotions_dlg.confused1}

I almost called the fire department the other night for (a neighbor) doing this. It was out of control.

They are illegal where I live, but the law doesn't seem to be enforced. It was explained to me that since we aren't allowed to burn trash or leaves outside, these aren't allowed either.

We just burn wood, and it's seasoned so it doesn't smoke a whole bunch.

I live in Philadelphia in a twin house. Our houses on the street are close to each other. I probably wouldn't mind if I were in the country. I don't feel that I (and my neighbors) should be subjected to the obnoxious smokey smell. I wish they WERE illegal cause it's making me sick.

In Ca, it would depend on the county. However, if they are burning illegal material that is another thing . Are you saying it smells like garbage, etc. if so I would call the fire department as they should be able to answer your question and investigate if they think necesssary. Your neighbor should not allow to much smoke to drift in your direction.

At times, open burning is banned. Depends upon fire risks. Call local municipality. They are the ONLY ones who can give you a definitive answer. Start with the fire department-non-emergency line.

A lot of people here in Az have them. However, I do not think their use is to burn garbage. We love them. Some folks actually have stone seating set around the fire pit. It's very relaxing on cool evenings.

It doesn't smell like garbage, but I know he's throwing all kinds of stuff in there. One day the ash was blowing down our driveway so thick I could hardly see.

Not illegal in Kansas. My neighbors bought one and luckily don't have a lot of their fire pit parties. They also put up a 6 ft fence this summer, so it's better. The only thing that bothers me is all the screaming and laughing going on. Our houses are pretty close together. I did mention to them that here you have to be quiet from 10:00 p.m. until 7:00 a.m. so that helped. I tell all the new neighbors that just so they know. Most people don't know their county rules. I try to say it in a nice way like I would hate for any of your other neighbors to turn you in for being noisy. Meaning me of course!

Burning trash inside the City Limits is illegal here. Having a fire pit to sit & enjoy is totally different. Call your City & ask them what their Ordinances are. I know how you feel. The farmers around here burn their fields because they are too lazy to disc them. It stinks & all the black particles from the burn ends up in our pool.

My neighbor also has one & I understand how you feel. Of course they seem to use it when the wind is blowing toward our house. It even makes the inside of our house stink.

And horrible rude neighbors who burn leaves for days and days year round, not just in the fall. I'm sick of my neighbors around here. It smells really bad and leaves make my allergies go crazy. They should just use their lawn mower and mulch the darn leaves and be done with it. Makes me steaming mad. Even when we have a drought and not suppose to burn they do anyway. I yelled at them once, they don't care. They make a party out of burning leaves, insane hillbillies.

need a permit to burn here....we have fire towers and if they see smoke the FD will be in the area in under 5 min! After dark it's ok, tho.

We have summer neighbors that have a chiminea (sp?). They buy 'special' wood that they love the smell of....and DH does NOT! The breeze in summer is out of the south, so over it comes and down go our windows! Luckily they aren't here all the time, mostly weekends.

They are legal where I live. My neighbor burns his doggy waste in his firepit. We just burn wood and some yard clippings in ours.

The guy that owns the house behind us- he rents it out, is burning now!!! I loathe it- he has all ready burned two other nights... I do believe a permit is needed, I've all ready yelled up the hill, "You're gonna burn us out." It's not like we are in the open either, trees and brush everywhere........ he's such an IDIOT...

Open burning is allowed in Arkansas so I guess fire pits are allowed too. If there is a drought, though, open burning is not allowed and the announcements are made on the radio and in the newspaper.

I absolutely hate the smell of burning leaves and you never know if poison ivy or oak might be in those leaves. My DH chops our leaves with the mower and just leaves them on the grass. In fact, he does it so I can't even see any leaves anywhere when he's done. He gets to spend time outside and we don't have a fire. It's a win-win situation.

The guy I mentioned above was burning at 3:30 this morning and still when DH got up at 6:15... it looks to be smoldering but nickel to a dime he'll have that fired up later... instead of throwing old wood out from redoing this rental house, he's chosen to burn it... grrrrrrrrrrrrrrrrrrrrrr I hate the smell of smoke... absolutely ruins a beautiful fall day, afternoon, night and now day again... we think they're pyro's..

I live in a townhome and we have wooden decks. There are idiots who have these pits on top of the wooden decks and one has theirs partially under. I would think this would be a fire hazard? And unfortunately it seems like these pits, at least around here, encourage people to sit outside later and drink.

I know someone who lives in a different townhome neighborhood and there was a group of people who would drag the pit out front on the sidewalk and drink beers. The HOA sent a letter around discouraging that {#emotions_dlg.laugh}

I think they are fine on bigger properties.
