New HP laptop wont download any windows updates

This morning i turned on my new HP lap top and it said updates were available, & it was in the process of downloading the updates and for some reason it would not install any of the 12 updates... it said updates failed, reverting back to something... so i called tech support which was in India, and was on the phone for about an hour & still couldnt get it to download the updates, he said windows 8 had some type of problem with the new system updating, at least i think thats what he said, couldnt hardly understand anything. So sending the computer back. Has anyone else experience any problems? It could be that i got a defective lap top or something.
