QVC sues Lessman

"QVC Inc., the home-shopping channel,sued Your Vitamins Inc. and its co-owner, Andrew Lessman, over allegedly false and misleading statements made through a rival television network.
QVC contends that Lessman, while promoting his Procaps vitamins on Home Shopping Network Inc., directed viewers to a Web blog that contains disparaging statements about QVC's Nature's Code products.
The blog “is devoted principally to denigrating the quality QVC's competing products -- and only QVC's competing products -- through the use of false and completely unsubstantiated allegations,” QVC lawyers said in a suit filed Feb. 5 in federal court in Wilmington, Del.
In the lawsuit, QVC asks for a jury trial, an order to stop negative statements, unspecified damages and legal fees. The complaint alleges false advertising, consumer fraud, deceptive trade practices and unfair competition.
Lessman wasn't immediately available to comment on the lawsuit at Your Vitamins in Henderson, Nev. "

A nuisance suit. Didn't Nature's Code copy Lessman? I'm guessing Lessman must be making a big dent into the Nature's Code market. I hope Lessman has his facts straight, but clearly the Q has more money/lawyers. :-(~Peach

Oh, I think Andrew will do just fine. He's an attorney, and I'm sure he has plenty of money for this legal fight. Go Andrew!

Not sure what happened between the two companies (I guess I am playing catch up here) but I would love to use Andrew's vitamins. They are just too expensive for me....I use GNC instead.

I am really shocked at hearing this. May i ask how,or where you got this information?
Just want to say i do use many of pro-caps vitamins,and do trust them to work for me..
Have done so much research,& checking many vitamin supplements both over the counter,and on the internet etc.
I do feel that his supplements are one of the best out there.
He is very knowledgeable,and also has the credentials to prove this.
His statements just show the difference between his,and other supplements out there.
He gives a full and detailed information on all the products he manufactures,with comparisons.
I personally cannot take any hard rock vit's since i have a very sensitive stomach.
Just my own experience with taking vit suppliments.

hmmmmm.....team QVC or team Lessman? As much as I love both this seems so childish. Lawsuit? really? What happened to freeness of speech. Isn't it the same as some venders knocking other products? "Toners are a waste of money, if a cleanser does its JOB you don't need it" yet the Q sells Clinique and they sell toners. Should Clinique sue? Or even 100% Pure selling their 'toxic chemical free' products? Should all the other brands that use parabens, silicones, phtalates, etc sue because it is assumed their products are toxic for whatever study or reason might be?
If it does affect sales in any way, what? take away a grain of sand from the sea and actually inform the consumer of what they are purchasing? In the end people will buy what they want and what works.

Andrew has a habit of putting down all other brands of vitamins and I've often wondered why he goes there, so to speak.
His quality product should speak for itself thus negate the need for him to stoop that low.
His enormous success on the other channel should be enough to stick it to the q -- the old adage, "being successful is the best revenge."

I recently watched Andrew, and he was saying something like--those vitamins on the other shopping channel--why do they put color in them when it's unnecessary?
I really wondered why he specifically mentioned the other channel. He could have just said avoid color in your vitamins. It was specific enough you knew it was QVC. I'm figuring he knew he could say it since he's a lawyer. Don't know if he's said anything worse.

Or when Leslie does the demo showing how "yucky" and bad liquid foundation is? Maybe this suit is because he definitely implied or mentioned Nature's Code specifically. I haven't seen the presentations so I don't know what was said, but it must have been enough that they felt a lawsuit was warranted. I bought Andrew's stuff when he was on QVC and never used them up. Tried a couple of his vitamins last year and they sit in the cabinet as I find no difference when I take them. I do take Nature's Code regularly.

I watched the recent AL shows and there were 2 points happening this year.
One was on his blog where he went into great detail about his Healthy Hair Skin and Nails product. QVC had a TSV on the Natures Code version, and he claimed they used the "same name" for the vitamins.
Then this last time, he was talking about his resveratol product, and he said, 'a product on another shopping channel has 99 per cent inactive ingredients!" I was very surprised to hear such a statement, rather bold. He did not mention the brand name but, this was also a recent TSV on the Q. I did also hear him say about the true color of resveratol and there is no reason to add color.
So I'm sure Natures code is upset that he stated how inferior their products were on air, even though he didn't say the brand name or the name of the other shopping channel.

Didn't Andrew used to be a lawyer for suits such as this? I'm almost positive he was. Then he came out with his own brand. I'm sure the guy knows what he's doing in these situations, & probably gets VERY frustrated when inferior brands make false claims. Team Andrew here. :-)

Both of these vitamin lines are ridiculously overpriced. I can get quality vitamins with no additives at my local health food store for half the price.

I just Googled...says Lessman is a Biochemist & former Food & Drug lawyer (he was a liability attorney).

Hi, golden! :-D Yes, I remembered when Andrew said he was a former FDA lawyer. He's a smart guy. He'll come out on top of this.
This does leave a bad taste in my mouth about Q. It sounds so childish .... waaaaaa, he's talking about us. Make him stop, Mommy!:^O
